Service Terms and Conditions
Welcome to Vodafone’s QSites SME Website Service (the “Service”). Your use of the Service is subject to these Terms of Service (the “Terms”). By using the Service you confirm your acceptance of the Terms, and your authority to do so from any organization on whose behalf you will use the Service. If you do not accept the Terms, do not use the Service.
Description of the Service
The Service is an online website creation and hosting capability that allows you to create and update a simple website for your business (a “Micro Website”). The Service is designed for users in the State of Qatar
During the registration process, you will receive an SMS on your registered Vodafone number containing a username and the password to access the Service. For security reasons, you are advised to change the password after the first login. You are responsible for maintaining the secrecy of your password and for changing it from time to time and Vodafone does not accept any loss or damage caused by your failure to safeguard your sign in credentials. You agree that the registration information you submit will be true and that Vodafone may withdraw your access to the Service if you do not comply with this term.
License and Intellectual Property
Your use of the Service does not convey any ownership to you of the software, hardware or communication facilities, or of the Service-provided content such as background images and type fonts that collectively enable the Service (the “Service Infrastructure”), and your use of these materials is on a license basis only.
Vodafone and its licensors, retain exclusive ownership of the Service Infrastructure and all rights therein including without limitation all trade secrets, patents, trademarks and copyrights therein. You will acquire no rights in or to the Service Infrastructure.
All text and other content you input, create and publish on your Micro Website as well as any third party content that you publish on your Micro Website with the permission of the third party (collectively “Your Content”) are the intellectual property of you and the third party and you and the third party retain all right and title to Your Content. You give permission to Vodafone to host Your Content for as long as you continue your Service registration and remain a Vodafone customer.
The Service will be offered and available to you, subject to the Terms, up to and including 17th September 2015 (“Initial Term”). Vodafone may upon expiration of the Initial Term deactivate your Micro Website upon which Vodafone may delete all of Your Content.
Your Commitment to Good Conduct
You agree to use the Service for your own lawful business purposes in accordance with the Terms.
You agree that you bear sole responsibility for Your Content on your Micro Website and have the authority to publish Your Content. You agree that Vodafone bears no responsibility for Your Content.
You agree that you will not:
1. Post content that contravenes any law of the State of Qatar;
2. Post content that is threatening, libelous, obscene or hateful;
3. Post third party content that you do not have the authority from the third party to post;
4. Commit any act that damages the Service or interferes with or disrupts the normal operation of the Service;
5. Attempt to interfere with the use of the Service by other users.
If you violate the Terms, Vodafone retains the right to remove any offending content and immediately deactivate your registration.
At any time you may, by sending an email to info@QSites.qa, deactivate your Micro Website upon which Vodafone may delete all of Your Content. Vodafone has no responsibility to archive or otherwise preserve Your Content once you deactivate your registration.
Vodafone retains the right to deactivate your registration and remove your Micro Website and Your Content without notice or opportunity to cure, if it determines that you have breached the Terms, or, in the event you are no longer a Vodafone customer, or the Service has been withdrawn for reasons beyond Vodafone’s control, or upon expiration of the Initial Term
The Service will be provided free of any cost to you during the Initial Term. If the Service is made available beyond the Initial Term some capabilities of the Service and additional services may be offered on a fee basis, subject to the terms and conditions to be agreed by you at such a time

Your Personal Information
You agree to indemnify Vodafone and save harmless its directors, officers, employees and partners from all claims, costs, damages and losses, including reasonably legal fees asserted by any third party, arising from your conduct, Your Content, your Micro Website or your breach of the Terms.
Disclaimer of Warranties
VODAFONE MAKES NO EXPRESS OR IMPLIED WARRANTIES AND EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THOSE OF NON-INFRINGEMENT OF THIRD PARTY RIGHTS, OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability
IN NO EVENT SHALL VODAFONE BE LIABLE FOR LOSS OF PROFITS OR SPECIAL, INDIRECT, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF USE, LOSS OF DATA AND LITIGATION COSTS, ARISING IN CONNECTION WITH THE SUPPLY, USE, PERFORMANCE OF THE SERVICE OR ANY WORK OR SERVICE PERFORMED BY VODAFONE OR ITS EMPLOYEES OR PARTNERS REGARDLESS OF WHETHER A CLAIM IS BASED IN CONTRACT, TORT, OR OTHER LEGAL THEORY AND EVEN IF VODAFONE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.
The Terms shall be adjudicated under the laws of the State of Qatar and the parties shall address any dispute to the courts of the State of Qatar.
If any provision of the Terms is declared by a court of competent jurisdiction to be invalid, illegal or unenforceable, such provision shall be reformed to the extent necessary to make such provision valid, legal and enforceable, and the other provisions of the Terms shall remain in full force and effect.
Vodafone shall not be liable for delay or failure in performance resulting from acts beyond its control, including, but not limited to acts of God, acts of war, fire, flood, or other disaster, act of government, strike, lockout, communication line or power failure, the failure, in-operability or destruction of any computer equipment or software, always provided that Vodafone shall take reasonable steps to prevent, correct or amend such act or event which renders such performance of its obligations impossible.
Any notice or other communication required under the Terms shall be sent to the email address provided by you or to info@QSites.qa.
Vodafone may assign its obligations to provide the Service at any time upon notice to this effect to you provided the assignee shall continue to be liable for the performance of Vodafone’s obligations under the Terms.
These Terms will be read and construed in accordance with the Service and any existing contracts or terms and conditions you have with Vodafone related to any other products or services and the like shall remain in full force and effect.
Changes to the Terms
These Terms are not intended to answer every question or address every issue raised by your use of the Service. Vodafone reserves the right to change these Terms at any time, effective upon the publication of modified Terms, and Vodafone will make every effort to communicate these changes to you by email or notification on www.qsites.qa. It is your obligation to read and understand the most recent Terms published. Your continued use of the Service will signal your agreement with the updated Terms.
